THE ROLE OF BANDUNG REGENCY LAND OFFICE IN PUBLIC LAND ACQUISITION

Land acquisition for public interest is a strategic yet challenging instrument of state administrative law, particularly regarding the protection of community rights and the implementation of good governance principles. This study analyzes the role of the Bandung Regency Land Office in implementing land acquisition for public interest development under Government Regulation Number 39 of 2023, using the GETACI Toll Road project (Gedebage–Tasikmalaya–Cilacap) in Cipedes Village, Paseh District, as a case study. A juridical-sociological method was employed, combining observation, interviews, and documentation. The findings show that the Bandung Regency Land Office has carried out all procedural stages of land acquisition in accordance with Government Regulation No. 39/2023, including inventory, compensation assessment, deliberation, and facilitation of objections. However, two substantive deficits remain: (1) the principle of legal certainty is not yet optimal due to incomplete ownership data; and (2) substantive justice has not been fully achieved because of gaps in compensation values that led to objections filed with the district court. Factors hindering the effectiveness of land acquisition include normative conflicts in assessing immaterial losses, limited human resources at the Land Office, an unintegrated land information system, and low public literacy regarding land law.
